Drug Scheduling in Michigan
Penalties for drug crimes vary by the type of drug and how much you've been accused of possessing, trafficking, or growing. Drugs are categorized into five Schedules, with charges of Schedule I being the most severe. Drugs are usually categorized by Schedule according to their potential for abuse or how unsafe they are to use, even under medical supervision.
Michigan's drug schedule is as follows:
- Schedule I drugs include LSD, peyote, ecstasy (MDMA), heroin, and marijuana.
- Schedule II drugs include cocaine, opium, oxycodone, and methamphetamines.
- Schedule III drugs include anabolic steroids, codeine, and some types of morphine.
- Schedule IV drugs include rohypnol ('roofies'), Valium, Xanax, among others.
- Schedule V drugs include medicines with trace amounts of codeine and opium.
Penalties: Possession of Schedule I or II Drugs
Conviction for possession of any substance in the two most serious drug categories will result in severe penalties. Possession is charged as a felony and could potentially result in lifelong imprisonment, depending on the amount you've been accused of having in your possession.
Drug possession penalties in Michigan include:
- 1,000 grams or more: Up to life in prison and $1 million in fines.
- 450-1,000 grams: Up to 30 years in prison and $500,000 in fines.
- 50-450 grams: Up to 20 years in prison and $250,000 in fines.
- Less than 50 grams: Up to 4 years in prison and $25,000 in fines.
Even the 'mildest' of sentences could completely wreck your future. Fighting your charges is your first priority–and if you call me, it'll be mine too. As a Bloomfield defense attorney, I have the track record and resources to give you a chance at the best possible outcome.
