Penalties for Misdemeanor and Felony Convictions

The penalties for conviction on misdemeanor or felony charges are harsh. The process of prosecution in misdemeanor and felony cases varies. If you are charged with a misdemeanor, the first hearing at which I should be present to protect your rights is at your arraignment, where you are formally charged. You will have the choice of entering a plea of guilty, not-guilty, or in some cases "no contest" to the criminal accusations. The judge can sentence you at this hearing if you plead guilty or no contest, or will decide to sentence you at a later date. The judge may also decide to set bail at your arraignment. If bail is an issue, I take action to get you released on your own recognizance or to reduce the amount of bail necessary to get you released.

The Criminal Justice Process

When you plead not-guilty, a pre-trial conference will be set by the judge in your case. The purpose of a pre-trial conference is to discuss whether a plea bargain can be worked out. Prosecutors frequently prefer this over a trial, as it can save them time and expense. A prosecutor could attempt to get you to agree that a plea bargain offer is best for you, but this may not be the case. I work to give you the straight facts on the option that will help you the most; a plea bargain or going to trial. After your pre-trial conference, both sides begin preparations for trial.

In a felony, the procedure is different but the fundamental steps of hearings, entering a plea, plea bargaining and legal actions to get ready for trial are similar.
